Terms of Service

1. Definitions

• “Partner store” means a store operated by a business that has a franchise agreement with us and rents vehicles through the Service.
• “Direct store” means a store operated by us.
• “Lessor” means the party that rents out the booked vehicle: us for direct stores, and the operator of the store for partner stores.
• “Rental Terms” means our terms setting out the conditions of vehicle rental.

2. The Service and our role

The Service lets Users search for, book and pay for vehicles at direct stores and partner stores. The rental contract is formed between the User and the lessor, under the Rental Terms. For vehicles at partner stores, our role is to accept the booking and to collect payment on the lessor’s behalf.

3. Registration

• You must register yourself, with accurate information. Registration requires email verification.
• You may register and sign in using an external account such as Google.
• We may refuse or cancel a registration if the information is false, if you have previously breached these Terms, or if we otherwise consider it inappropriate.

4. Your account

You are responsible for keeping your password and account secure. We are not liable for loss caused by a third party using your account, unless caused by our wilful misconduct or gross negligence.

5. When a booking is made

A booking is made when you confirm the details on the booking page, register a credit card, and we send you a booking confirmation email. The vehicle class, dates, store, insurance plan, extras and price are shown in the confirmation email and on My Page.

6. Prices and payment

Prices are as shown on the booking page (consumption tax included). You register a credit card when you book, and we charge it automatically from 00:00 (Japan time) seven days before your pick-up date. If you book less than seven days before pick-up, we charge at the time of booking. If the charge fails we will email you and try again five and three days before pick-up. In the meantime you can also pay with another card from My Page. If payment has still not gone through by the day before pick-up, the booking is cancelled automatically (no cancellation fee). Any additional charges arising after the rental (see “Other charges” below) are charged to the registered card.

7. Cancellation by the User

You can cancel from My Page or by contacting us. The cancellation fee is based on the time the cancellation is completed:

Cancellation fees are capped at ¥6,600 for K/S class, ¥8,800 for G/SUV class and ¥11,000 for F1/F2/V class (tax included). “Total booking amount” means the full amount of the booking, including the vehicle charge, insurance plan, extras, after-hours fees and one-way fees. Refunds are made to the card used for payment. Depending on your card issuer, it may take from a few days to about a month to appear on your statement. If we or the partner store cancel your booking, you receive a full refund.

8. Cancellation by us or the lessor

If a vehicle cannot be provided because of natural disaster, breakdown, accident or other unavoidable cause, we or the lessor may cancel the booking. In that case we refund the amount paid in full and have no further liability, except where caused by our or the lessor’s wilful misconduct or gross negligence.

9. Charges after the rental

If fuel, late-return charges, traffic-violation costs, the non-operation charge (NOC), uncovered damage or other costs set out in the Rental Terms arise during or on return of the rental, you agree to pay them and we may charge them to your registered credit card.

10. Prohibited conduct

• Registering or booking with false information, or using a card in someone else’s name
• Letting anyone other than the registered driver drive, or subletting the vehicle
• Using the Service or the vehicle for illegal purposes or against public order
• Interfering with the Service, unauthorised access, or bulk automated access
• Infringing the rights of us, partner stores, other Users or third parties

11. Suspension

If you breach these Terms we may, without prior notice, cancel your bookings, suspend your account or take other necessary measures.

12. Limitation of liability

• We try to keep the information on the Service accurate, but a vehicle’s appearance, colour and equipment may differ from the photos.
• We may suspend the Service temporarily for network failure, maintenance or other unavoidable reasons.
• Where we are liable to you for damages, except in cases of our wilful misconduct or gross negligence, our liability is limited to the amount you paid for the booking concerned.
• The above does not apply where it is not permitted under the Consumer Contract Act or other law.

13. Personal information

We handle your personal information in accordance with our Privacy Policy, and provide it to the lessor of your booking to the extent needed to hand over the vehicle.

14. Changes to these Terms

We may change these Terms in accordance with the Civil Code. Changes take effect when posted on this page. Prices and cancellation conditions of bookings made before a change remain as they were at the time of booking.

15. Governing law and jurisdiction

These Terms are governed by Japanese law. The Osaka District Court has exclusive jurisdiction in the first instance over any dispute relating to the Service.

16. Language

The Japanese version of these Terms is the governing text. Translations are for reference; if they differ, the Japanese version prevails.
